Regulation (EC) No 883/2004 and Regulation (EC) No 987/2009 shall also apply to nationals of non-EU countries who are not already covered by those Regulations solely on the ground of their nationality, provided that they are legally staying in the territory of a Member State and are in a situation which is not confined in all respects within a single Member State.
As a typical example, a Dutch employer hires a Russian national who works as an employee in two or more EU Member States and who remains living in Russia.
As per the Dutch Social Security Authorities this rule only applies to non-EU nationals who are living in a Member State. However, today the European Court has decided that legal stay in a Member State is sufficient for this purpose. This procedure was initiated by LIMES international on behalf of one of its clients.
